Through his lawyer, the 34-year-old accused of having caused a rear-end collision in which Raffaele Degioannis , a 68-year-old from Cagliari, lost his life, requested the abbreviated procedure.

The Public Prosecutor, as part of the vehicular homicide proceeding, had asked for the indictment at the end of the preliminary investigations.

AP, a 34-year-old from Dolianova, formulated his request subjecting it to the action of one of its own technical consultants and the acquisition of a biased expert opinion. The requests were accepted by the judge as was the filing of a civil action by the victim's family members, assisted by the lawyer Carlo Salvatore Usai and by Studio3A-Valore Spa.

The hearing was postponed to next September 14th.

According to the kinematic report entrusted by the deputy prosecutor to the engineer Silvia Falqui Cao, the death of Degioannis - after the accident that took place on the evening of 28 September 2021 in Dolianova in via Cagliari while the man was on his electric bicycle - would be linked to the failure to respect the safety distance by the defendant, as well as in the excessive speed maintained. Driving a car, he traveled via Cagliari, a section of the Provincial road 14, heading from Dolianova towards the State road 387, traveling at an estimated speed of 85 km/h, higher than the limit established at that point of 70 km/h, he noticed in time that the car preceding him in the same direction, a Peugeot 308, had braked at the sight of the electric bicycle.

Being too close, he would have braked sharply trying to pass the car in order not to hit it, but he failed, hitting it on the rear left corner with the front right corner of his car. And due to the violent rear-end collision, which also destroyed and threw the vehicles off the road, the Peugeot 308 was in turn pushed forward, running over the bike and the cyclist with its side, who also ended up under the car.

Degioannis, who was well known in the city for having managed a newsstand for many years before retiring in 2020, immediately appeared in desperate conditions and died after five days of agony, on October 3, due to very serious multiple traumas reported, in particular a cranial-brain and thoracic trauma.
