Yesterday the Council of State returned, at least provisionally, the tables to the Bar Florio, one of the two venues in Piazza San Domenico, in the Villanova district of Cagliari, sanctioned last week by the Municipality with the forfeiture of the concession of public land for 18 months. This is a precautionary ruling, therefore not of merit, but which at least until early January will allow the business to start serving customers again even outside.
The president of the fifth section of the Council of State accepted the request for suspension that the defender of the premises, Aldo Luchi, had presented against the effects of the sentence of the Regional Administrative Court of Sardinia which had agreed with the Municipality, deeming the suspension of the concession for 30 days legitimate : a measure adopted after a fine from the local police, imposed because the music emitted from the speakers inside could also be heard in the square. It was the second of the same type, which resulted in the forfeiture for a year and a half.
The decision is now frozen, awaiting the ruling on the merits. The next few weeks, at least at Florio, the tables will return.
