They had won the first round, getting the suspension of the concession for outside tables frozen. But the Ninnos and Florio clubs in Piazza San Domenico, in the Villanova district, lost their appeal to the TAR against the Municipality of Cagliari .

The administrative judges considered the sanction imposed to be legitimate after an inspection by the local police who, at the beginning of May, had contested the fact that the music emitted from the speakers inside the premises could also be heard in the square because the door «was constantly kept open ». And now also for the TAR, which confirmed the validity of the suspension of the concession for 30 days.

The owner of Ninnos had turned to lawyers Matilde Mura and Giulia Atzori, while those of Florio had turned to lawyers Aldo Luchi, Monica Murgia and Jacopo Fiori.

By challenging the Municipality's measures, they managed to avoid being left without tables and chairs in good weather. Now the sanction risks becoming enforceable. The defenders' arguments are rejected. For the TAR «for the purposes of the applicability of the established sanction, what is relevant in the case in question is the mere audibility outside and in the concession areas», of the music, «regardless of the acoustic levels found, as well as the reasons for Cui the same occurred, despite the instrumentation being located inside the establishment".

The rulings of the Sardinia Regional Administrative Court on the subject are therefore proving that the hard line taken by the Municipality and the Office for Productive Activities led by the manager Alessandro Cossa and represented before the administrative judges by the lawyers of the legal office, Francesca Frau and Simonetta Garbati, are right.
