He underwent five surgeries in a short period of time for intestinal obstruction and died due to post-operative complications. A few weeks ago, his family won the legal battle against the doctors at Arnas Brotzu in Cagliari, obtaining a huge compensation of 1.1 million euros.
The story was reported by the Ansa agency. The victim of the "case of medical malpractice" was a 75-year-old from Cagliari, who died in the summer of 2021.
"According to the findings of the technical consultants appointed by the court - explains the Rome lawyer Gabriele Chiarini, who followed the case - there were late diagnoses of post-operative complications, errors in the management of surgical procedures, as well as insufficient monitoring of the post-operative course . The deficiencies found irreparably compromised the patient's possibility of recovery, unfortunately leading to his death".
In December, again according to what was reported by Ansa, the civil court thus recognized the responsibility of the health facility for violation of diagnostic and therapeutic protocols.
"The lack of prudence, diligence and expertise on the part of the doctors involved has been ascertained - the lawyer specifies to Ansa - The compensation, totalling more than 1.1 million euros, has been awarded to the closest relatives as compensation for the moral and material damages suffered. In particular, the sentence has recognized the pain and existential upheaval caused by the loss of the relative in absolutely avoidable circumstances".
For lawyer Chiarini, «the compensation obtained, although significant, cannot restore the loss suffered, even if it represents an important step towards the recognition of a fundamental right of all patients: that of receiving adequate care that complies with high-quality healthcare standards».
