Cagliari, new sports center in Monte Urpinu: the Region wins at the Tar

The sports center inside the former fuel depot of the Air Force in Monte Urpinu has yet to (re) be born, but the battle to manage it has already begun and there is a first winner: the TAR rejected the appeal that Blue Tribune Srl had presented against the Region and the Cra (corporate leisure center) of regional employees.
The former military space was decommissioned in 2007. Since then, the large green area of Cagliari has been used as a deposit for disused furniture. It was to become the citadel of the third sector, then of solidarity. And then it should have housed the offices of the Forestry and the Regional Department of the Environment. Nothing was done.
The only resolution that could become enforceable was that of 23 December 2020 which assigned the space where expanses of disused mateco stood to Cra and Cral of the Region: the associations had presented a project to build padel, football and tennis courts. A possible redevelopment, which was opposed by the entrepreneur Marco Isola, interested in investing in the area to build (himself) sports facilities.
The assignment, he argued through his lawyers, had to take place through a tender, since it is a public good and there was more than one person who aspired to manage it.
The judges of Piazza del Carmine have reconstructed all the passages. And they considered crucial part of the provision of the junta led by Christian Solinas: the assignment to the regional associations had occurred because they had been deprived of a concession in Terramaini, which arrived after the one revoked at Poetto, behind the Marino hospital, to make room at the heliport. So not a simple direct concession, that of Monte Urpinu, but a compensation for assets due and taken away for reasons that did not depend on Cra and Cral.
The appeal was therefore rejected. It is not excluded, however, that the ball passes to the Council of State, if the Blue Tribune Srl should decide to challenge the first instance sentence. Meanwhile, on the eastern side of Monte Urpinu, immobility reigns 15 years after the liberation from the stars.
