The Sardinian Regional Administrative Court (TAR) has suspended, effective immediately, the ordinance issued by the Municipality of Olbia that had ordered the closure of the San Pantaleo restaurant "Giagoni in Piazza."
The administrative judges accepted the requests of lawyers Gian Comita Ragnedda and Dorotea Fiori.
The Regional Administrative Court (TAR) ruled that the restaurant in the Olbia area is located in a square where adequate space is available for public safety. The measure was taken, according to the Municipality of Olbia's arguments, due to excessive and dangerous occupation of public land.
The argument was rejected by the administrative judges. On September 25th, the Regional Administrative Court (TAR) will hear the case, but, as Giovanni Giagoni's lawyers requested, the restaurant has since reopened. Now a legal battle has begun regarding the restrictive stance of the Municipality of Olbia.
