The trial for the misdirection of the investigation into the Via D'Amelio massacre in which Paolo Borsellino and the escort agents (including Emanuela Loi) died ended with two prescriptions and an acquittal, but the reasons filed today by the court judges of Caltanissetta leave no room for doubt. It wasn't just a mafia massacre .

There was " the moral and material participation of other individuals and/or power groups other than the Cosa Nostra interested in the elimination " of the judge. The involvement of third parties would be demonstrated by «the anomalous timing of the massacre (which took place just 57 days after that of Capaci), the presence reported by the repentant Gaspare Spatuzza of a person unrelated to the mafia at the time of delivery of the Fiat 126 stuffed with TNT and the disappearance of Paolo Borsellino's red diary ».

"It is not random to argue - it continues - that the timing represents an element of anomaly with respect to the traditional behavior of Cosa Nostra aimed, as a rule, at diluting its criminal actions over time in the case of institutional targets (especially in the case of magistrates) and this in the logic of curbing the reaction activity of the institutions».

Again, on the involvement of pieces of the institutions: « The anomalous and mysterious presence of a subject extraneous to Cosa Nostra - the judges concluded - can only be explained in the light of the institutional affiliation of the subject , since the fact of allowing a third party extraneous to the mafia coterie to become aware of such delicate and prejudicial circumstances for the subjects involved as the preparation of the car bomb destined to kill Paolo Borsellino».

Chapter on the red agenda: «Unless we hypothesize improbable scenarios of mafia members roaming among dozens of members of the police forces, it can be considered certain that the disappearance of the red agenda is not attributable to a material activity of Cosa Nostra », reads one of the passages of the sentence.

From this, “two logical consequences follow. In the first place, the institutional affiliation of those who had materially stolen the agenda . The elements in the field do not allow the exact identification of the natural person who proceeded with the removal of the agenda, but there is no doubt that it could have been only someone who, due to the functions covered, could intervene undisturbed in that specific space-time context and, for prior knowledge knew what was necessary or appropriate to subtract.

"Secondly - conclude the judges - such an invasive, timely (and unfortunately effective) intervention in the elimination of such an important probative element to reconstruct - not today, but already 1992 - the motive for the Via D'Amelio massacre certifies the need for subjects external to Cosa Nostra to intervene to alter the framework of the investigations, preventing it from being possible to effectively investigate the non-mafia origins of the massacre (which are added, as already mentioned, to the mafia one) and, ultimately, reveal their involvement in the Via D'Amelio massacre».

The sentence, issued last July, declared the charges against Mario Bo and Fabrizio Mattei time-barred, two of the three policemen who ended up on trial for the pollution of the investigation, and acquitted the third defendant Michele Ribaudo .

According to the Public Prosecutor's Office, the three, under the direction of their boss Arnaldo La Barbera, who later died, allegedly created the fake pentiti Vincenzo Scarantino, Salvatore Candura and Francesco Andriotta , prompting them and forcing them to lie and accuse people who later turned out to be innocent of the massacre. A castle of lies that helped the real culprits get away with it and covered up the responsibilities of the clans of Brancaccio and the Graviano brothers for years .
