Sentenced to 21 and 14 years in prison for killing the violent father. The episode dates back to 10 August 2020 and took place at the height of a dispute in the home of the two boys in the San Biagio district of Genoa.

Alessio and Simone Scalamandrè are 30 and 22 years old, their father Pasquale was 62. The man was under investigation for mistreatment of the boys' mother - who was not with her children on the night of the crime, having long since been transferred to a facility protected in Sardinia - and had gone to his children's home to ask the major to withdraw the charges against him for the trial that would take place shortly.

A quarrel arose at the height of which the 62-year-old was repeatedly hit with a rolling pin and other objects.

Alessio and Simone Scalamandrè were accused of voluntary murder in competition, aggravated by the family relationship, a crime for which the minimum sentence is 21 years (the prosecutor Francesco Cardona had asked for 22 and 21 years). Precisely for this reason, Alessio's lawyer, Luca Rinaldi, had raised, with the favorable opinion of the prosecutor, the question of the constitutional legitimacy of the article of law provided for by the so-called Red Code, which prevents the extenuating circumstances from exceeding the aggravating circumstances in the event of a restriction. of kinship.

The Assize Court in calculating the sentence of the younger of the two brothers, Simone, applied article 114 of the penal code which refers to the "minimum contribution" of the accused in the commission of a crime in competition, one of the few extenuating circumstances which allows the penalty to be significantly reduced, as requested by Simone's lawyer, Nadia Calafato.

The two boys, who silently and composedly witnessed the reading of the sentence, left the courthouse together with their lawyers who are awaiting the reasons for appealing.

Satisfied the plaintiffs lawyers Stefano Bertone, Irene Rebora and Greta Oliveri: "Sentence that strengthens our conviction that the two defendants killed their father in a cold and calculated manner".
