For the death of Serena Mollicone, the Court of Assizes of Appeal of Rome confirmed the acquittal of Franco Mottola, his wife Anna Maria and his son Marco.

Serena was found dead in a grove in Arce (Frosinone) on June 1, 2001.

After reading the sentence, Franco and Marco Mottola, visibly moved, hugged the lawyers. The prosecution had requested the sentencing of Carabinieri Marshal Franco Mottola, to 24 years, his wife Annamaria, to 22 years, and their son Marco, to 21 years. He had instead asked for the acquittal of the other two defendants, the carabinieri Francesco Suprano, due to the statute of limitations, and Vincenzo Quatrale, because the evidence did not reach the level of proof.

Serena Mollicone disappeared from home on June 1, 2001 and was found lifeless after three days in the Fonte Cupa woods in the nearby Anitrella area of Monte San Giovanni Campano. «I am very saddened. This is not justice", commented Consuelo, Serena's sister, and her uncle Antonio asked that "everything be done to achieve justice". "I have the duty as an Italian citizen and Serena's uncle to ensure that justice for Serena emerges because up to now it has not yet emerged."
