Seven-year-old boy slaughtered, his father does not respond to the investigating judge. The lawyer: "Too tried"

Davide Paitoni, the 40-year-old arrested for stabbing his 7-year-old son and trying to kill his wife from whom he was separating in the late afternoon of January 1st, between Morazzone and Gazzada Schianno, made use of the right not to answer province of Varese.

According to his lawyer Stefano Bruno "he was not in a position to sustain the interrogation".

"I advised him not to answer because he was unable, being too tried," the lawyer said. Then, he added, "I have not yet had the opportunity to discuss what happened with my client, at the moment I am dealing with the human side".

The man is accused of murder with the aggravating circumstances of premeditation and cruelty, and attempted murder. In the afternoon, the investigating judge of Varese Giuseppe Battarino validated the arrest.
THE CAUTION MEASURE - A formal separation was not underway between Paitoni and his wife, the two were still negotiating the terms through the lawyers. The woman had reported him for ill-treatment twice between 2020 and 2021, and her parents had reported him: a "red code" would therefore be open, of which, however, the outcome is not known at the moment.

Yet Paitoni had obtained from the investigating magistrate of the Varese Court to be able to see his son despite the measure of pre-trial detention under house arrest for attempted murder of a work colleague and complaints from his wife. It was not considered dangerous by the judicial authorities.

"The order for house arrest was signed on November 29, endorsing the measure requested by the magistrate", explained the president of the Court of Varese, Cesare Tacconi, "who motivated it with the danger of probative pollution, not with the social dangerousness, and the judge cannot aggravate the prosecutor's request ". Subsequently, continues the President of the Court, "the defense attorney of the suspect asked that he be allowed to see his son and his wife, since according to the ordinance he could not have contact except with family members living together, therefore the father" . On 6 December "the investigating judge authorized the man to see his son". With regard to the woman's complaints and the red code, Tacconi specified that "there is no pending charge in the court against the man, so if there are complaints, they are still in the public prosecutor's office". Then he concluded: "I have carried out all the necessary investigations, between the two there was no formal separation in progress, if I will be formally requested I will present a report".

THE CRIME - On the evening of January 1, Paitoni grabbed a knife and hit his son Daniele in the throat, and then tried to kill his wife too after joining her in the parents' house where she had moved.

Daniel's body hid it in the closet, on top of a letter full of anger towards his wife and the message for his father: “Forgive me”.

The carabinieri arrested him at the first light of dawn on January 2: he was trying to escape.

THE MINISTER SPEAKS - On the crime of little Daniele, sources in via Arenula report that the Minister of Justice, Marta Cartabia, asked the inspectorate to "urgently carry out the necessary preliminary investigations" on the case.
