The acquittal sentence was overturned and a new appeal trial was held for the Arce crime.

This is what was requested by the Attorney General of the Court of Cassation at the end of his closing speech in the proceedings against the former commander of the Arce barracks, Franco Mottola, his wife Anna Maria and his son Marco, accused of the murder of Serena Mollicone, which occurred in June 2001 in the centre of Frosinone.

During his speech, the prosecution representative stated that he "shares and supports the appeal of the Rome Attorney General's Office" against a sentence that presents "multiple violations of the law".

The Attorney General speaks of a "macro flaw" in the sentence due to a lack of motivation: it is "a totally lacking sentence" and has a "Pilatesque attitude". What was crystallized by the Court of Assizes of Appeal of the Capital, continues the Attorney General, "fails to motivate the presence of Mollicone that morning in the barracks of Arce. A plurality of clues were not evaluated in a unitary manner".
