She had killed him with a stab while he pointed a knife to her throat. Now the Turin Court of Assizes of Appeal has also acquitted her in self-defense.

The facts date back to last September 2, 2018: Silvia Rossetto , 50, was at home with her partner in Nichelino, in the Turin area, when the two had yet another discussion. Giuseppe Marcon, 65, suddenly threatened her by bringing a blade to her neck. And she, according to what was reconstructed, in reaction grabbed a knife from the kitchen cabinet and hit him straight in the heart, killing him.

The sentence confirms what was established by the GUP: it was legitimate defense and the fact does not constitute a crime. The prosecutor, who had asked for a sentence of nine years and six months, had challenged the first instance sentence talking about culpable excess, but the court agreed with the defense lawyer Sergio Bersano.

"We were in the kitchenette - Rossetto's story -. Giuseppe grabbed me by the neck and pointed the bread knife to my throat. I took the first object I found in the open drawer and to escape the grip I turned. I hit him like that, without even realizing it. "

Subsequent investigations made it possible to ascertain this reconstruction of the facts.
