Macerata judge Claudio Bonifazi did not validate the arrest of the 40-year-old woman accused of having thrown her 4-year-old daughter from a window on the third floor of a house in the Marche city, causing her to end up in hospital, where she is still hospitalized with a prognosis reserved .

The decision was made on an objection raised by the defense of the woman, of Indian origin, against whom pre-trial detention in hospital was ordered.

According to the psychiatric service, the 40-year-old, represented by the lawyers Valentina Romagnoli and Andrea Netti, is "strongly depressed" and it is better that she does not go to jail for now.

The woman, who according to the lawyers is still under the influence of psychotropic drugs , also asked to speak with her husband and sister, but did not answer the questions of the investigators .

"According to the testimonies, everything suggests that the lady had a blackout ", explained the lawyer Romagnoli. Speaking with journalists at the conclusion of the validation hearing, Romagnoli also reported that the woman "asked to know how her daughter is" and to be able to speak with her husband and sister.

"His state of health appears incompatible with the precautionary measure: he is in a very strong depressed state and will remain in hospital for now".
