The reasons for the sentence with which the Court of Assizes of L'Aquila sentenced to 12 years in prison - on charges of unintentional homicide and complicity in robbery - the Cuban Carlos Omar Morales , aged 24, and the Romanian Alexandru Dumitru Balan , aged 37, accused of having caused the death of Teodoro Ullasci, a 52-year-old of Sardinian origins (Siurgus Donigala, then the family moved to Cagliari) who lived in L'Aquila, will be published on March 5.
The prosecutor Guido Cocco had asked for 24 years and 10 months of imprisonment.
The man was found lifeless on March 22nd of last year in via Fortebraccio, in the historic center of L'Aquila, near the San Bernardino steps: according to the prosecution, the two defendants had attacked Ullasci with kicks and punches for the purpose of robbery, in particular one of them hit him with a cobblestone that was confiscated; in the end they had taken away a wallet with a little money and a cell phone.
Ullasci suffered from a disability resulting "which made him incapable of defending himself validly ; in particular, the death occurred due to the violent punch he received in the face which caused ventricular fibrillation with consequent cardiocirculatory arrest", as stated in the prosecution documents.
The Assize Court panel, presided over by Giuseppe Romano Gargarella, ruled out Morales' recidivism.
