The Florence prosecutor's office has requested that Marcello Dell'Utri and his wife Miranda Ratti be sent to trial in relation to the failure to communicate changes in their assets , which Dell'Utri was required to do under the Rognoni-La Torre law as he was convicted with a final sentence for external association with a mafia-type organization in 2014.
The charges, to varying degrees, are of fraudulent transfer of values and failure to communicate the variations which, in the balances of a decade, the Dda of Florence has estimated for an amount of 42,679,200 euros . In March 2024 the Dda had obtained the preventive seizure of 10.8 million euros identified in the flows in the current accounts of Dell'Utri and his wife.
The Florence DDA identified these cash flows as forms of support that Silvio Berlusconi had provided to his friend Dell'Utri . Among the bank flows investigated by the DDA, 10 transfers of 90,000 euros recently arranged by Silvio Berlusconi in favor of Dell'Utri as a "donation of modest value" emerged, plus one of 20,000 euros as a reimbursement, between May 19, 2021 and May 22, 2023. The investigations also revealed interest-free loans, maturing in 6 years and without installments, disbursed in several instalments for a total of 10.5 million by Berlusconi to Miranda Ratti from 2016 to 2020.
According to the charges, these movements of money from Berlusconi to Miranda Ratti's accounts after April 2018 - the investigating judge Antonella Zatini detected a total of 8,250,000 euros out of a total of 10,840,000 euros seized - were actually in favor of Marcello Dell'Utri, but he did not communicate anything to the authorities . The request for indictment that the Florentine prosecutor's office has recently made is also based on these charges.
