Hearing today in Cassation, with Covid rules and quota entries in the courtroom, to discuss the appeals of the carabinieri convicted for the beating of Stefano Cucchi, the young Roman who died following the beatings received in the night between 15 and 16 October 2009 in the barracks Casilina after being arrested for drugs.
"It is a moment of great tension - the comment of the Cucchi family's lawyer, Fabio Anselmo, entering the courtroom - after 150 hearings and 14 degrees of judgment, 15 with today".
The Pg of the Cassation, Tomaso Epidendio, asked for confirmation of the sentences for the four carabinieri involved in Stefano's death. In particular, he asked to confirm the convictions for manslaughter against Alessio Di Bernardo and Raffaele D'Alessandro and the related sentence of 13 years in prison. Also to be confirmed is the 4-year sentence for forgery against Marshal Roberto Mandolini and the responsibility for the same crime for Francesco Tedesco, even if only for him the Pg asked for cancellation with postponement in relation to the sanctioning treatment. A bis appeal could, therefore, reduce the amount of the sentence for Tedesco (two years and six months), if he received the granting of generic extenuating circumstances.
"VIA CRUCIS NOTTURNA" - "It was a nocturnal via crucis that of Stefano Cucchi, carried from one station to another" underlined in the classroom the Pg of the Cassation Tomaso Epidendio with reference to the beating suffered by the young surveyor by the carabinieri in the Casilina barracks , in 2009 in Rome, "and all the people who came into contact with him after the beating were impressed by Cucchi's condition: it is a large number of subjects including nurses, escort personnel, prisoners, guard officers . Can we really believe that this impressive number of subjects has conspired against the carabinieri? ".
"These are professionally trained subjects who are faced with a predictable reaction, and not even the most striking, during the arrest of Stefano Cucchi who refuses to undergo photo-signaling", Epidendium stressed in the courtroom, adding that the beating carried out by the carabinieri in the caserma Casilina "was a corporal punishment of extraordinary gravity, characterized by an evident lack of proportion with the uncooperative attitude of Cucchi". For this, the Pg asked for confirmation of the aggravating circumstance of the futile reasons for the defendants.
