Using his daughter's social account - according to the indictment - the defendant would have convinced a little girl to undress and touch herself in front of the webcam . The first instance sentence was pronounced in November 2001 by the panel presided over by judge Simone Nespoli. After the investigation, the prosecutor Gilberto Ganassi had asked for the indictment of the 58-year-old, accusing him of sexual assault at a distance. The little one, according to the prosecutor, would have been convinced that on the other end of the computer there was a girl of her age , instead the investigations then ascertained that the father was there.

However, there was no trace of the victim's photo on the PC, nor were the technicians able to clarify whether the defendant had actually guided the little girl's actions via webcam. This uncertainty - underlined by the defense - convinced the Court of Appeal to consider solicitation and sexual violence not committed crimes, but only attempted ones . Hence the declassification that triggered the extinction due to the statute of limitations, canceling the 6-year sentence.
