The Constitutional Court did not accept the request to suspend the Todde government's moratorium on renewable energy plants .
The Constitutional Court has also set the hearing on the merits for December 11th, in which the appeal for constitutional legitimacy filed by the Meloni government against Law 5 of 2024 on the blocking of new plants for 18 months will be discussed.
In the appeal , the Council of Ministers had also requested an urgent measure to suspend the effects of the law , justifying it with the "risk of serious and irreparable damage to the public interest or to the legal system of the Republic or to the rights of citizens".
Request rejected. The Region's legal defense had objected that "the law does not appear to constitute a clear violation of the Constitution nor does it present a danger for the achievement of the energy transition objectives for 2030."
In the Regional Council, meanwhile, the process of the law on suitable areas has begun, which, once approved, will repeal the moratorium . If the green light were to arrive before December 11, the matter of contention between the State and the Region would therefore cease.
