Acquitted of the charge of sexual assault because the fact does not exist.
This was the ruling today in court in Sassari, by the panel presided over by Judge Monia Adami, with Valentina Nuvoli and Paolo Bulla on her side, for an incident dating back to 2016 when, in Alghero, at the end of a night of high alcohol consumption, a 37-year-old woman woke up without remembering anything of what had happened. The only clue was a note left by a person with whom she had spent the evening, a 33-year-old from Alghero.
At that point the woman fears that she has been raped and that she has unknowingly taken the so-called "date rape drug". For this reason she reports the occasional partner but, at first, the case is archived, only to be resumed once traces of GHB are discovered in a hair of the injured party.
However, this test does not resolve the dilemma of whether the substance, in minimal quantities, is the result of the drug or is self-produced by the organism.
After the prosecutor Angelo Beccu had requested a two-year sentence, today the discussion of the civil party and the defense was held. In the first case, represented by the lawyer Luigi Esposito, it was argued that the sexual relationship between the two had occurred and that the man had taken advantage of the alleged injured party and her state of impaired defense.
Defense attorney Marco Salaris, on the other hand, reported that none of this had happened and that the 33-year-old, who was also drunk, had behaved in a way that demonstrated his unwillingness to take advantage of the woman's drunkenness.
