A group of real estate companies and private individuals has won an administrative dispute over the installation of a mobile phone repeater (an 18-meter pylon) in the heart of Porto Cervo . The appeal was against a provision of the Municipality of Arzachena (number 368 of September 14, 2023), with which the installation of a technological system "for mobile phone telecommunications on a multi-manager structure in Porto Cervo, via della Goletta" was authorized.
The case had also been raised by the minority councilors, Fabio Fresi and Rino Cudoni, who had contested the actions of the municipal administration. The TAR ruling in effect rejects the decisions of the Municipality of Arzachena, on whose side the Region and the Superintendency of Sassari have sided .
The administrative judges agree with the private individuals (owners of villas in the area where the system was installed) and establish that, as far as possible, the proliferation of pylons must be avoided . The ruling states: "The current regulatory discipline of the Municipality of Arzachena is very clear in considering the installation of new telecommunications infrastructures within sites that already host similar infrastructures as a priority, considering the choice of different sites as residual and practicable only where the described location is concretely impossible".
