Three years to Sascha Michael Rossmann , director of EnervitaBio San Cosimo, for aggravated fraud to obtain public funds .
This is one of the passages of the sentence issued this morning in court in Sassari by judge Giulia Tronci on the photovoltaic systems of Giave . According to prosecutor Giovanni Porcheddu, who supported the accusation, Rossmann, through some deceptions on state incentives for the production of electricity obtained from photovoltaic conversion of the solar source, would have received aid for 8 million and 831 thousand euros.
Sentences also of one year and 10 months for Franco Tocco and Raffaele Giardino , but with the conditional suspension for the former, respectively sole director and legal representative of the Esmeralda agricultural company. They would have issued non-existent invoices relating to cultivation services in favor of EnervitaBio. Acquittal instead for the three, and also for Walter Siddi, director of Atlantia Investimenti, for the disputes on the invoices relating to the irrigation systems.
The magistrate also ordered the confiscation of the land and the photovoltaic system , the dismantling of the second and the possible sale of components. The same direction also for the land that the judicial sales institute will take care of. Then ordered the confiscation of the 8 million and 831 thousand euros by the magistrate who, finally, also rejected the request for compensation from the municipality of Giave. On the decision concerning Rossmann, his lawyer, Giuseppe Conti, has already announced that he will appeal.
The other lawyers were Massimo Bonvicini, Matteo Pinna, Gianluigi Poddighe. In sixty days, Tronci will file the reasons for the sentence.
