Fraud in public supplies and breach of contractual obligations.
These are the disputes from which the managers of the companies that manage the paid parking service in Oristano will have to defend themselves : the legal representative of the Stop company, Eduardo Chiodoni, the president of the The park consortium Matteo Chiodoni and the legal representative of Easy Help Davide Pensalfini ( defended by the lawyers Gabriele Satta and Settimio Honorati) have been indicted.
According to the prosecutor Armando Mammone, the three would not have complied with the clause in the specifications which provided for the use of an inspector for every 80 parking stalls nor the commitment, undertaken with their technical offer, on the frequency of the checks (8 auxiliaries for 64 hours of daily control, 10 auxiliaries for 40 hours on Saturday).
Furthermore, they would not have complied with the clause on maintaining the level of 18 employees and would have employed the staff hired for Oristano in other municipalities (San Vero Milis, Portoscuso, Ozieri, Porto Pino and Teramo), thus missing the necessary employees for controls in the city. Finally, it is disputed that to hide the non-compliance with the personnel clause, employees who were not auxiliary or worked in other municipalities where the companies managed similar contracts were made to appear as employees of the The park consortium (a company set up by Easy Help and Stop).
Attorney Satta has raised some objections, in particular the charge would have been integrated at a later time by not guaranteeing the defence. Judge Salvatore Carboni rejected it, setting the hearing for November 16th. The Municipality of Oristano is a civil party with the lawyer Gianna Caccavale.
