After three appeals to the TAR (all accepted) presented against the acts issued, on several occasions, by the municipal administration to reorganize the spaces of the San Pantaleo market, yesterday the itinerant traders who set up the stalls in the tourist village presented a new one ( the first) to ask for the suspension of the effectiveness of the provisions that transfer it to via Sangallo in Olbia , where one of the two local markets of the city is held on Saturdays, contested by the operators for the impossibility of reaching the same attraction which, for twenty-three years in the hamlet, it has attracted thousands of visitors and tourists.

Already contested by the Tar, the reasons of "public interest corresponding to the needs of better viability and road traffic safety" placed at the foundation of the transfer of the summer market, considering them "not prevailing over the interests of private individuals", in the new appeal, the reasons are disputed by dismantling the safety and health plan drawn up by the Municipality for the regular performance of the activities (mandatory but with the management costs borne by the operators), and reporting an event which, in recent days, has made the village hit the headlines Olbia. The appeal brings to the attention of the Court a resolution by the Giunta which authorized the company Villa Eugenie srl to use the square of San Pantaleo to organize a private event, a dinner with six hundred guests and shows by well-known artists, making San Pantaleo, for four days , the scene of an event with a strong impact.

«And what happened to the safety and health care praised by the mayor? Where is the security plan adopted for this event of international importance? What safety measures and precautions have been taken by the Municipality to avoid accidents and damages?», reads the appeal which asks the mayor to explain, with the support of authorizations possibly issued before the event, why the same precautionary rules would not apply which it intends to apply to the historical market whose area of development would become «dangerous and unhealthy only on Thursday morning».

According to the appeal, the transfer of the market would have been decided "without any scientific evidence from which the complained dangers for the safety of visitors could emerge, limiting themselves to drawing up a Plan, established on the basis of the notes of the Local Police and the Fire Brigade on the matter of safety that has nothing to do with the market». Given, the appeal says, that the findings did not reveal any infringement of the safety rules by the itinerant operators, in support of the Plan a ministerial directive issued on the occasion of the riots that occurred in Turin during a Champion League match, in 2017, is referred to which is in no way applicable to the local market of San Pantaleo. In order to prevent the continuation of the "municipal plan" harmful to the interests of the workers, whose concessions are seasonal and the start of their activity has been postponed by a month, the street vendors ask for the suspension of the effectiveness of the acts, the immediate adoption of a specific relocation provision in the San Pantaleo area and the appointment of an ad acta commissioner in charge of establishing the methods and location of the stalls.
