The Court of Appeal of Trieste overturned the first instance sentence and acquitted Loris Tramontin, legal representative of Azalea promotion, for "not having committed the deed", accused of culpable disaster, manslaughter and multiple culpable injuries in the trial for the collapse of the stage occurred on the morning of 12 December 2011 at PalaTrieste, before a concert by Jovanotti.

In the accident, Francesco Pinna, a 19-year-old of Sardinian origins, who was in charge of the assembly, had lost his life.

The judicial process began in 2014. With the first degree sentence, dating back to May 2019, it was claimed that Tramontin had not indicated a "safety coordinator", a figure also suitable for verifying the structural problems of the stage. The accused was then sentenced to one year, 10 months and 15 days with suspended sentence.

Yesterday, however, "for the first time the Court of Appeal accepted in full the appeal of the accused and of Azalea as civilian responsible", explains the lawyer Caterina Belletti, who defended the Friulian company. The thesis, also supported by Riccardo Cattarini, who defended Tramontin, pointed to the fact that "Azalea was simply the local promoter and not the client of the execution of the entire work and therefore in a complex tour like that of Jovanotti it was not up to Azalea to appoint a fundamental role such as that of safety coordinator: this element could not be obtained except from a line of a contract that had to be contextualized. Obviously, the pain of the terrible tragedy remains ".

In 2014, the engineer in charge of the static check of the stage was sentenced to 3 years of imprisonment with an abbreviated rite.
