With only a few hours left until the Green Pass obligation comes into force in all workplaces, Draghi has signed the Dpcm that integrate the decree and define all the rules with which millions of Italians will have to live with starting from Friday.

Instead, users are excluded. Those who do not have a pass must be removed immediately and every day of non-service is considered unjustified absence (with holidays and non-working days that are included in the account). The salary is suspended from the first day of absence but "in no case" can you be fired. Furthermore, no contributions or holidays accrue during the period of absence.

If the absence of the employee should lead to "an interruption of an essential service", the administration can establish an agreement with other entities or use internal mobility between offices and different areas.

CHECKS - They must be done every day, at access to the office or even later, on a carpet or sample basis in a measure of not less than 20% of the staff in service, and ensuring a constant rotation so that everyone is checked.

To avoid delays and queues at entry, employers will be able to establish greater flexibility in entry and exit times. The "VerificationC19" App or the new tools provided by the Dpcm can be used for the checks, which will allow a "daily and automated" verification, detecting only the possession of the pass and no other employee data. It is possible to integrate the QR code reading system with the turnstiles or with the devices for detecting the temperature, and the software will communicate directly with the national platform that issues the certification.

PROHIBITION TO STORE THE QR CODE - Other important aspects: for the employer, public and private, there is "an explicit prohibition" to keep the QR code of the certification, and it is not possible "in any case" to collect the data of employees "except those strictly necessary for the application of sanctions".

ADVANCE REQUEST - It will also be possible to request the pass in advance from the employee in case of company shifts, but this advance must be "strictly necessary and in any case not exceeding 48 hours".

PENALTIES - Those who "cheat", entering the company without a certificate, in addition to staying at home without a salary, will have to pay an administrative penalty ranging from 600 to 1,500 euros. And it risks a disciplinary sanction from the company, in the most serious cases, according to law experts, it can even lead to dismissal. Furthermore, the employer must report to the Prefect the worker who entered the company without a certificate.

THE CASE OF HAIRDRESSERS AND TAXI DRIVERS - Hairdressers, beauticians and all operators of personal services do not have to check the green pass to customers, as they themselves are not obliged to show it. The same goes for taxi drivers and chauffeured car rental drivers.

PADS TO THE PORT - There is also a circular from the Interior Ministry on the possibility for port companies to offer free pads to their employees.

In the first, the head of cabinet of the ministry, to avoid blocking the ports in the event of a high number of employees without the green pass, "recommends" the prefects to "solicit" companies to evaluate the possibility of making available for free the tampons.

An ambiguous formula, especially on who - in case - should pay for the tests, which requested a second circular. Companies "will be able to evaluate, in full autonomy, every possible organizational modality for the purpose of acquiring the green pass by employees without". Should they decide to do so, the cost would therefore be borne by them and not by the state. However, the circular opens a case and in fact the unions immediately took the opportunity to ask for the request to be extended to the entire transport sector.
