The sentence of the Sardinian TAR should arrive in the next few days on the appeals related to the tender for territorial continuity presented by Volotea and Ita on the exclusion - at different times and for different reasons - from the tender with the urgent procedure for the award of facilitated flights to and from the island.

For each of the two airlines there were three appeals, one for each of the banned routes, then assigned to Volotea for seven months (until May 2022) , but with subsequent negotiated procedure.

In the meantime, Ita gave up the legal battle on the routes from Alghero and Olbia (and vice versa) and the one between Cagliari and Milan-Linate and vice versa, insisting only on the recourse relating to the Cagliari-Rome section , considered the most strategic.

The Spanish low cost carrier had been excluded from the tender due to the lack of some formal requirements considered essential by the tender commission (documents). Shortly after, however, the other participant, Ita Airways, was equally excluded for what was defined - in a communication to the Regional Council by the Regional Transport Councilor, Giorgio Todde - a lack of "technical requirements to participate" .

The Ita lawyers Filippo Modulo, Giulio Napolitano, Emanuela Ticca Devoto, Alfredo Vitale and Luca Masotto presented themselves today before the college of the first section of the Administrative Court of Cagliari, chaired by judge Dante D'Alessio. For Volotea there were, however, the lawyers Laura Pierallini, Ilaria Gobbato and Michele Carpagnano. The Sardinia Region was represented by the lawyer Mattia Pani.

Now the judges will meet in chambers to decide and then the provision will be published and notified to the parties.
