The Ministry of Labor reached an agreement with the social partners on the national protocol with the guidelines for collective bargaining on smart working in the private sector, proposed by Minister Andrea Orlando.

The CGIL, the CISL, the UIL, the UGL, the Confsal, the CISAL, the USB, among the workers' unions, have given their membership.

For the employers have signed Confindustria, Confapi, Confcommercio, Confesercenti, Confartigianato, Cna, Casartigiani, Alliance of cooperatives, Confagricoltura, Coldiretti, Cia, Copagri, Abi (which can sign it following the resolution of the Executive Committee), Ania, Confprofessioni, Confservizi, Federdistribuzione, Confimi and Confetra.

The agreement defines the guidelines for the use of agile working after the Covid emergency, underlining that collective bargaining is the "privileged source of regulation" of smart working.

According to the new rules, adherence to this way of working is on a voluntary basis (no employee can be obliged) and will only be possible after the signing of an individual agreement between the worker and the company.

The duration must be indicated in the contract (term or indefinite); alternation between periods in the office and those outside the company premises; the places possibly excluded for the performance of the service; work tools; rest times and measures for the right to disconnect; the methods of checking the performance; training.

The protocol explains that the performance will be characterized by the absence of a precise working time and by the autonomy in working for pre-established objectives. It will not be possible to work overtime and a time slot must be identified in which the worker must not be connected and operational.

For the worker, the salary will not change, even if the issue of meal vouchers is still under discussion.

The employee can choose to free the place in which to perform the service in an agile mode, provided that the necessary conditions of "security and confidentiality" exist.

Finally, it will normally be up to the employer to supply the necessary technological devices but the parties can also find an agreement on the use of tools owned by the worker, possibly providing for "forms of compensation".
