With 32 votes in favour , one against (Alessandro Sorgia of the League) and 21 abstentions (of the opposition), the Regional Council approved the Council's moratorium which prohibits the construction of new renewable plants for the next eighteen months . The text passed with very few changes . Among others, a proposal from Fratelli d'Italia to allow the operation, in derogation of the moratorium, of agrivoltaic systems no larger than 10 megawatts. However, the amendments on green hydrogen and repowering were rejected .
All the territorial areas to be subjected to safeguard measures are identified in the law. Among others, protected natural areas, wetlands of international importance and those that fall within sites of community interest, agricultural areas and those at hydrogeological risk, those less than seven kilometers from cultural heritage (1500 meters in the smaller islands) , the band 300 meters from the shoreline, areas burdened by civic uses and of archaeological interest. Excluded from the application of the safeguard clauses, in addition to agrivoltaic systems under 10 megawatts, those for self-consumption, and ordinary, extraordinary maintenance or revamping of electricity production and storage systems from renewable sources.
According to the Urban Planning councilor Francesco Spanedda , «this bill has the function of leaving space to work in a long-term perspective which includes the law on suitable areas and the new regional energy plan». During the explanations of vote, Stefano Tunis clarified that «the measure will not avoid speculative ceilings. Only the purpose remains." “We expected something more,” said Angelo Cocciu (Forza Italia). For Fausto Piga (FdI) «the law is weak, with a high risk of challenge. The committees were not listened to. Today, you who are against differentiated autonomy are not respecting the autonomy of Sardinia." Alberto Urpi recalled that «well before the regional elections, local administrators had pushed for the moratorium». For Alessandro Sorgia (Lega), «it is a weak moratorium which will lead us to countless appeals, which will be challenged, and which represents a slap in the face to our Statute». According to Gigi Rubiu (FdI), «this is not the saving of Sardinia but the law of postponing the problem». Umberto Ticca (Reformers) underlined that the vote will be to abstain due to the ineffectiveness of the law. For Luca Pizzuto (Future Left) «the ecological transition must be one of our objectives, but the wealth produced by the 6.2 gigawatts must remain with the people of Sardinia». Antonello Peru (Sardinia at the center of 20Venti) claims that «we have missed an opportunity, the measure is sterile and not very effective». According to Paolo Truzzu , "the majority has locked themselves into a fence, we have tried to lend a hand but a timid law has emerged which does not even grasp the problem of the return of resources to the communities". Roberto Li Gioi (M5S) recalled that the previous council "brought the island one step away from the abyss, and we started from there". Antonio Solinas (Pd) does not hide that he would have preferred the unanimous vote: «The appointment is in a few months when we will decide where to install the systems».
