«Very serious damage to the Sardinian territory»: the report on the wind assault illustrated to the citizens

A judicial route that joins the numerous political and popular initiatives to combat the invasion of wind and photovoltaic plants on Sardinian territory .
The Scientific Committee for Insularity in the Constitution illustrated in Pattada – in a meeting organized by the association “Rinascere” – the complaint presented to the eight Sardinian Public Prosecutors to «obtain that, once the appropriate investigations have been ordered, those deemed responsible for having caused or contributed to causing the very serious and irreversible damage to the Sardinian territory are prosecuted» . In the event that this happens, the committee will constitute itself as a civil party but every citizen can join the initiative.
The president of the committee Maria Antonietta Mongiu started from the concept of landscape and its protection as a right of citizens that, according to different regulations. « The landscape is protected by our Constitution – she explained – and it is a superior good . The Draghi decree is not the table of the law and moreover it should have provided for a different regime for regions with special statutes like ours and it did not do so».
There are two fundamental principles on which the complaint is based: the irreversibility of the damage that would be caused to the Sardinian territory and the lack of participation of citizens in decisions that concern the environment and the landscape, as explained by Gianvalerio Sanna, former regional councilor for Urban Planning . A right established by a series of rules from international conventions to European law and the Constitution. A valid instrument to counter the assault on the territory would be the landscape plan extended to the internal areas, a tool that Sardinia does not currently have. And it is precisely on the basis of a landscape plan that a wind farm on Monte Amiata was blocked in Tuscany.
"The Council of State has established that the landscape is a primary asset and that it cannot be cancelled by other regulations - Sanna then commented - but this was also possible because in Tuscany there is a landscape plan that protects that area. It is a primary and decisive tool".
Gianni Marilotti wanted to link today's meeting to what he called the day of European pride, Europe as a place of people's rights. "Our report," he explained, "is based on the principle of insularity and we hope it will be a battle for all democrats who care about Sardinia."
