New and clearer rules for the use of beaches and the management of state concessions in Sardinia . The Region has approved the resolution which «makes greater clarity for hoteliers who want to put down sunbeds and umbrellas. The possibility of celebrating weddings and authorizing sporadic activities linked to sporting events has also been confirmed. Furthermore, those who have a kiosk on the beach, without sunbeds and umbrellas, are given the opportunity to take advantage of an area of up to 50 square meters where they can place tables and chairs.

But there is also another novelty: the Region has decided to enter into an agreement with OIS (Works and Infrastructures of Sardinia) which aims to provide a picture of the situation of the occupation of the state-owned area throughout the island. An initiative "also useful for understanding what the margins are for allowing new authorizations and verifying the state of health of the beaches". Among the measures, the withdrawal of sea water is also allowed, free of charge and with a fortnightly frequency (withdrawal from 20.00 to 7.00 in the morning).

"It is a measure eagerly awaited by the operators, which we considered urgent by virtue of the approaching bathing season", explains the councilor of the local authorities, Aldo Salaris, who proposed the resolution approved in today's session. Going into the specifics of the various authorizations to be issued to operators " we also considered it appropriate to provide guidelines aimed at standardizing, for the 2023 season, the administrative procedure to be followed, among the various territorial services, for the investigation of the different types"

This resolution will be followed by the seaside ordinance and a new resolution which will approve the guidelines of the Pul, on the basis of which the administrations will then be able to prepare the Plan for the use of the coasts.

Here are all the directions

Seasonal concessions for hotels and health facilities in Municipalities without Pul. In the absence of Pul it is allowed to issue concessions to accommodation and health facilities (hotels or homes for the elderly or, for example, facilities that provide health care) which must be located at a distance of 1000 meters from the sea, calculated by the accommodation or health facility to the beach where the concession is requested and placed.

Also in the absence of an approved PUL, accommodation and healthcare facilities already in possession of seasonal concessions in previous years are without prejudice to this limitation for the year 2023. These concessions, which are for sunbeds and umbrellas only, must be annual, seasonal in nature (valid only for the current season).

Food and drink kiosks on the beach that do not have sunbeds and umbrellas. For the first time, the Region is going to help small structures located on the beach that intend to have tables and chairs to allow the use of food and drink in the kiosk itself. The kiosk will be able to prepare an area that does not exceed the total area of 50 square meters for the 2023 bathing season only.

Finally, the bars and restaurants that are off the beach but in front of the beach will be able to set up tables for customers from 20.00 in the evening to 7.00 in the morning, always useful for serving food and drinks for a limited area, a maximum of 200 meters paintings and always for the summer season only.

Authorizations for the placement of launch corridors or tared cables. These are authorizations relating to safety to safeguard the safety of bathers. They do not involve the exclusive occupation of maritime state property and are intended for public use to allow the landing and departure of boats. For the positioning of launch and landing corridors or tarozzati cables (buoys that delimit bathing in the sea) authorization is required from the Territorial Services of the Region, subject to the opinion of the maritime authority, in compliance with the technical procedures dictated by the Ordinance of the Port Authority.

The launch corridors are authorized at 200 meters between one lane and the other, but in the case of existing concessions or those envisaged by the PUL, land-based rental of boats (canoes or pedal boats, for example), the authorizations will be issued in front of the concession .

Concessions for wedding celebrations on the beach. Wedding celebrations must take place after the granting of a concession in which one or more special areas (which will have to set them up) are identified by each Municipality. Concessions may also be issued in the absence of a Coastal Use Plan, therefore in free beach areas. The Municipality will also be able to celebrate the wedding in state-owned areas already subject to concession.

The assignment to private subjects of state-owned areas on the coast for the holding of parties, events or ceremonies of a personal nature is prohibited.

Film or photo shoots. There is growing interest in Sardinia as a privileged destination for photographic or cinematographic filming which often involves the occupation, even exclusive, of stretches of water or beach. "If on the one hand it is evident the opportunity not to give up these opportunities which, among other things, arouse a significant advertising impact for Sardinia", explains Councilor Salaris, "on the other hand the need emerges that the use of maritime is in any case compatible with the interest in ensuring the public and free use of the beaches, in the interest of Sardinian citizens and tourists".

Areas on the beach to support concessions on stretches of water. This is the seasonal occupation of land areas of limited extension (three meters by three metres) which allow for the carrying out of the negotiation, ticketing, surveillance, possible rescue phases, relating to the (tourist or nautical) concession exercised on the nearby body of water .

Beach furniture (chairs, table, gazebo umbrella) or, if permitted, safety furniture (e.g. life jacket) may be placed in the areas to be removed entirely at the end of the day.

Areas on the stretches of water to support the functional activities of the mooring fields (shuttle). The Region gives the holders of concessions for mooring buoy fields the possibility of having a body of water available, which does not exceed 30 square meters, where to position a vessel to be used exclusively as a shuttle. The new area will preferably be located laterally to already authorized launch corridors with the aim of minimizing interference with bathing.

Areas for social utility. The rules for dog areas are better regulated; areas for the installation of structures to support disabled people; play areas for children. In this case, in the absence of the PUL and pending its approval, where the municipal administrations have proceeded with the establishment of these areas of social utility, they will be able to entrust them in management (with seasonal authorization) to sports associations or non-profit associations . However, the areas must remain accessible to all.
