They had been suspended from work for non-compliance with the vaccination obligation. Now the TAR has rejected the appeal of the three employees of Ats Sardegna against that decision.

The three nurses had requested the cancellation of the suspensions ordered by Ats for not having carried out anti-Covid-19 vaccinations, in accordance with the provisions of law decree n. 44/2021 for reintegration into the workplace. But, according to Ats, the TAR has established that "collective health justifies the temporary compression of the right to work of the individual who does not want to be subject to the vaccination obligation".

"We are very satisfied that the TAR has proved us right with a sentence that reaffirms the correctness of our work - comments Massimo Temussi, Extraordinary Commissioner of Ats Sardegna -. Once again, the administrative judges on the vaccination obligation of health professionals have affirmed the absolute legitimacy of the suspensions adopted by Ats Sardegna, in compliance with Legislative Decree 44/2021 which introduced the aforementioned obligation ".

In the three ordinances, with identical reasons, the Sardinian TAR also stated that "from another point of view, the interest in mitigating the impact of the effects of the pandemic on the NHS - in terms, above all, of hospitalizations and employment of intensive care units - which could lead to the uncontrolled spread of the Covid-19 disease in subjects - such as health workers - naturally exposed, to a greater extent than the average, to the risk of contagion ".
