Tempio, doctor no vax reinstated: it is the first case in Northern Sardinia

The first hospital doctor in northern Sardinia who had not undergone vaccination against covid has been reinstated .

Judge Eleonora Carsana of the Tempio Pausania court decreed today, who accepted the appeal of doctor MLB, suspended from the service of the hospital of the same city since April 26 of this year.

The measure was decided by the socio-sanitary company n. 2 Gallura and the Board of Directors of the Order of Medical Surgeons. At the ASL, the judge orders the professional's readmission to service and orders that the salaries accrued from the day of suspension to the day of actual reinstatement be paid .

The medical director, defended by the lawyer Liliana Pintus, in the readmission application, denounced the constitutional illegitimacy of the vaccination obligation raised by some legal precedents and asked for the right to the maintenance allowance that had been taken away from her.

He also stated that he had seventy days of past leave and two hundred hours of leave as well as having contracted the virus this year, from which he has in the meantime denied himself.
