Trial to be redone for Pasquale Serra, 60 years old, arrested in June 2023 in Golfo Aranci for the crime of attempted murder.
The man was taken to prison, accused of having hit his neighbor, Nela Codreanu, with a harpoon . The victim, hit in the temple by the sharp spear, lost the use of one eye .
Serra, defended by lawyers Pietro Carzedda and Antonia Mele, was acquitted (no need to proceed) due to irreversible incapacity to stand trial . Now the Attorney General has appealed the Tempio Tribunal's sentence and the case will be re-examined by the Sassari Court of Appeal.
An expert opinion had established that Serra was capable of understanding and willing at the time of the facts, but he was no longer so, and irreversibly, at the time of the trial (October 2024) . After the sentence the man was released.
Lawyer Cristina Mela , the civil party's lawyer, had opposed the decision not to proceed and had expressed concerns about Serra's release.
