"A "historic" step forward, but still incomplete" . This is how the effect of the Constitutional Court's ruling 68 was defined, with words that oscillated between emotion and determination, which on 22 May 2025 recognized the right to parenthood also for the intentional mother in cases of medically assisted procreation (PMA).
To celebrate it and discuss its concrete consequences on the territories, a meeting was held in the council chamber of Palazzo Bacaredda in Cagliari, promoted by the Famiglie Arcobaleno association with the participation of the mayor Massimo Zedda, the deputy mayor Cristina Mancini, members of the Executive and the City Council, representatives of the Municipalities of the Metropolitan City and Lgbtqia+ associations.
A sober, participatory, and at times emotional atmosphere. A moment of confrontation but also of mutual recognition, in which institutions and activism tried to define together the next steps to fully implement the sentence.
Mayor Zedda opened the meeting : «The Constitutional Court has filled the political void in recognizing rights to those who do not have them. The Municipality of Cagliari has immediately applied the ruling, allowing in this case a little girl to have two mothers finally recognized as such. A spring of rights has started precisely from the local administrations: a great deal of work has been done over the years, from the registry of de facto couples in the Municipalities that have forced Parliament to give an answer, even if still deficient. We must continue on this path and the Metropolitan City offers to support the practical application in the civil registries».
Silvia De Simone, external representative of Famiglie Arcobaleno Sardegna, also underlined the value of the sentence, speaking of a victory that was both long-awaited and partial :
"The Court's ruling has made possible what we have wanted for a very long time. After 15 years of activism, this victory is half a revolution because women who have had children through medically assisted procreation (PMA) have been de facto recognized. For men it is different, for them this recognition is still a crime. The good news is that we now have the legitimacy to make these recognitions and we will fight for everyone. What can we do? Recognize the children who are about to be born and will be born, but the law is also retroactive so recognize them all."
On a practical level, in fact, the ruling allows municipal offices not only to register new births with two mothers, but also to correct existing birth certificates, retroactively recognizing the parental bond between the child and the intended mother.
On the front of actions to be undertaken in the Municipalities, Filippo Viola of the Lenford Network , proposed targeted training interventions, which directly involve local authorities: «Training is also needed on the topic of surrogacy and in the procedures for rectifying this gender in municipal offices».
The meeting was closed by Francesca Loi, internal representative of Famiglie Arcobaleno , with a collective appeal to the sense of community: «The sentence is also important for grandmothers and grandfathers. And you administrations are also part of this village of rights».
