The first civil section of the Court of Cagliari, chaired by Ignazio Tamponi, authorized the mother to organize the vaccination of the child "regardless of the consent" of her husband, "without prejudice to any other different evaluation of the doctor of the hub" and with the use of drug "suitable for the case".

In the reasons, the Court also reported the statements of the minor, who complained of the father's "lack of clarification" on the refusal (the man in the case spoke of "possible health consequences").

The Court also recalls that the government and the Italian society of paediatrics have asked to proceed with the immunization of 12-18 year olds, underlining that "the benefits outweigh the risks in all age groups, including the youngest ones".
