The owner of land containing the facilities and infrastructure of a land reclamation consortium must always allow access to maintenance personnel, especially in the event of an emergency like the one that occurred last July in one of the areas of the North Sardinia consortium.
This is the ruling of a landmark ruling by the Court of Sassari, which also ordered the defendants to pay costs. A break in a consortium irrigation pipeline had disrupted water supplies to dozens of farms in the area.
The consortium technicians, called to urgently intervene for the repairs, however, encountered obstacles and resistance from the landowner, who had repeatedly denied access to the affected area, including to the maintenance company. The matter was then brought before the Court of Sassari, which recently ruled that the Land Reclamation Consortium's actions were fully legitimate.
