New rules for bonuses and Superbonus, the protest of Confartigianato Sardegna

“We now spend more time intercepting and understanding the new rules, unraveling the bureaucracy and explaining the new legislation than opening construction sites, redeveloping buildings, letting businesses work and creating a new economy. We are very worried about yet another change of course by the government against home bonuses and Superbonus ".
The criticism comes from Maria Amelia Lai, President of Confartigianato Sardegna, on the news against fraud in the use of building bonuses, introduced in the Sostegni ter Decree , approved by the Council of Ministers.
The law provides that the tax credit corresponding to Superbonus, restructuring bonuses, eco-bonuses, sismabonus and facades bonuses be sold only once. This means that the beneficiary of the deduction will be able to assign the credit to other subjects, banks and financial intermediaries, but these will not be able to assign it in turn; suppliers who apply the discount on the invoice will be able to recover the discount in the form of a tax credit and transfer it only once to other subjects, but the latter will not be able to transfer it.
According to the trade association, in this way it will be very difficult for companies to assign credits and, consequently, the most penalized will be the customers, who will have difficulty in starting the work. Furthermore, the provision will hit heavily the world of plant engineering that works, for almost all cases, with deductions of 50 and 65%.
“The continuous changes to the functioning of the Superbonus and of all the other home bonuses - continued Lai - create profound uncertainties such as to discourage an important market such as that of Sardinian construction and plant engineering which was growing in a solid and sensitive way. Our businesses are serious and operate fairly and we do not accept that they are penalized by a few who behave outside the law ”.
"We have always been the first to ask for control and rigor in combating fraud and rewarding serious and virtuous companies - said the president of Confartigianato Edilizia Sardegna, Giacomo Meloni -, but we cannot continually hit thousands of citizens and correct committed companies. in energy redevelopment interventions, which will now necessarily have to review the contractual conditions with the owners, generating thousands of disputes and a blockade of the market ".
In addition, another change would be coming from the government in February: a new rule could make the minimum requirements decree binding, provide for all-inclusive maximum unit prices not only for goods but for all interventions in eco and Superbonus, in replacement of price lists. An intervention that could lead to further confusion.
According to Confartigianato, in Sardinia construction runs and beats all records (23 thousand companies and 49 thousand employees throughout the home system), but there is still a heavy bureaucracy that slows down a sector that in the first eight months of 2021 has grown significantly overwhelming. The island's turnover in the sector, driven by the home bonus effect and Superbonus, increased by 35.9% compared to the pre-Covid period, compared to + 30% nationally, placing over 500 million euros of liquidity on the construction market.
For the Superbonus 110%, in Sardinia the declarations in December 2021 totaled 3,138 for a total of investments equal to 541 million euros and investments for completed works of 349 million euros. The condominiums recorded 242 declarations for 209 million deductions (average investment of 865 thousand euros), for single-family houses the declarations are 2,068 for 240 million investments (average investment 116 thousand euros), while for independent houses the declarations are 828 for 91 million of investments (average investment 110 thousand euros).
“It is not possible that in the face of these numbers the government responds every month with some new regulation that generates confusion and risks stopping the construction sites - concluded Lai and Meloni -, this is not the system to curb abuses and irregularities. Against fraud, we have long asked for clear rules to avoid speculation, such as the introduction of reference price lists for all bonuses and a company qualification system, given the recent proliferation of improvised operators. But so far, apart from some good intentions, nothing has been done, while in this way serious companies are being hit ”.
