For the serious mistake made in the operating room, which cost the life of a 10-month-old baby, three people will go to trial in Turin. It is a surgeon, an anesthesiologist and the director of the pediatric surgery facility of the children's hospital in the Piedmontese capital.

According to what was reconstructed in the request for indictment, on April 15, 2021 the little one had undergone an operation to correct a lung malformation. He would have been operated "not by a pediatric surgeon experienced in pediatric thoracic surgery" but by an adult doctor, who cut his thoracic aorta "instead of occluding the abnormal blood vessel". The anesthetist would not have "implemented an clinical observation, so as not to notice in time the error committed by the surgeon". And the director of Pediatric Surgery is called into question for having indicated "as the right person" to perform the operation the surgeon who committed the error, the which however before then he had already done "12 operations of pulmonary surgery" and "5 pulmonary lobectomies".

The child's family, represented by the lawyer Michela Malerba, invokes "respect and silence", and above all "the most total and rigorous anonymity" regarding the little patient.
