Olindo Romano and Rosa Bazzi , sentenced to life imprisonment for the Erba massacre , could be innocent and victims of a judicial error .

This is supported by Cuno Tarfusser, deputy attorney general of Milan, who is now asking to reopen the case . The spouses could therefore be serving the sentence without having any fault. The reasons for the request , filed on April 12 , were clarified by Tarfusser in a 58-page document, in which he took into account the work of the defense pool of Olindo and Rosa in recent years. The massacre took place on 11 December 2006 : four died , Raffaella Castagna and her two-year-old son Youssef, Raffaella's mother, Paola Galli and one of their neighbours, Valeria Cherubini. The only survivor , but injured, is Valeria's husband, Mario Frigerio, who died last January.

According to Tarfusser, the recognition made by the latter may not be reliable as it is the result of a "false memory". And the couple's confessions were allegedly obtained with " incorrect investigative interviewing techniques ." The blood stain found on Olindo's car also raises further doubts. These are the three main tests contested by the deputy attorney general. For Rosa and Olindo therefore, there could already have been a " different procedural site " at first instance. The prosecutor will decide whether to accept Tarfusser's request, then giving the go-ahead for the transmission or not of the request to the Brescia Court of Appeal.
