Child on bike hits an elderly woman who dies: father under investigation for murder

With the help of his father he had to learn to ride a bike without training wheels at the age of 5 in a public garden in Milan . But the day turned into a drama: the child, still uncertain on two wheels, hit an 87-year-old woman who hit her head when she fell and died shortly after in hospital .
Now the father is under investigation for manslaughter , he is responsible for the child and his actions.
The incident took place last March: father and 5-year-old son were in the park because the little one had removed the wheels from his bicycle and was learning to pedal safely, with the help of the parent who was following him. In the same park, the 87-year-old woman was walking in the company of a friend.
A very normal day until the little one lost control of his bicycle and skidded and crashed into the woman . The impact was not violent but it was enough to cause the 87-year-old to lose his balance and fall to the ground, where he hit his head.
At first the old woman was conscious and talking, it would have been the father of the child who insisted on calling the ambulance . The situation then precipitated because the woman lost consciousness and died in hospital.
The Milan Public Prosecutor's Office has launched an investigation into the matter following which the child's father was investigated for manslaughter, since the child is under 14 and therefore not attributable .
The parent, the judges argued, was required to supervise the minor and therefore the omissive conduct would be his responsibility , because the child could not realize the effects and extent of his actions.
This affair has a judicial precedent with a 2010 Supreme Court ruling. In that case, the father was charged with culpable injuries, with a seventeen-day prognosis, because the son, riding a mini electric motorcycle, had run over a Sardinia .
