Attacks on doctors, draft law: arrest in flagrante delicto and five years of imprisonment

These are the main measures contained in the draft decree law to combat violence against healthcare professionals that the Government is working on .
In the first case, the draft decree sanctions more severely the conduct of damage when this is carried out "inside or in the appurtenances of residential or semi-residential health or social-health facilities, public or private , with violence to the person or with threats or on the occasion of the crime provided for by article 583-quater" (personal injury to a public official).
The amendment to Article 380 of the Code of Criminal Procedure extends the scope of mandatory arrest in flagrante delicto to include those conducts that are classified as "crimes of personal injury to personnel practicing a health or social-health profession and to anyone who carries out auxiliary activities functional to it" and to those who commit "crimes of damage" . The amendment to Article 382-bis extends the applicability of deferred arrest in flagrante delicto to crimes "for which arrest in flagrante delicto is provided" that are "committed inside or on the premises of residential or semi-residential health or social-health facilities, public or private, to the detriment of persons practicing a health or social-health profession".
The decree also allows the installation of video surveillance systems, appropriately marked, within healthcare facilities following the adoption of specific guidelines by the Minister of Health, in agreement with the Minister of the Interior.
