The Sardinian TAR filed the six sentences on the Volotea appeals and the last two sentences on the Ita appeals relating to the completion of the tender for the assignment of the air territorial continuity service.

The appeals were completely rejected, with the rejection of all the grounds for objection.

In particular, the TAR highlighted the "shareability of the defenses of the regional lawyer" and the "correctness of the decision of the contracting authority in excluding both competitors from the first tender, as well as the Italian company from the second".

Lastly, the panel noted that the extraordinary importance of the air transport procedure in territorial continuity justified the special attention in verifying the actual possession of the availability of the aircraft at the start date of the service, on which Ita did not provide adequate feedback.
