Todde Forfeiture Case: What Happens Now?
In the very short term, the steps are defined. Today the Elections Committee is meeting, the body of the Regional Council responsible for evaluating cases of incompatibility or ineligibility (which are sent back to the Chamber for validation or annulment). President Giuseppe Frau has already agreed on the line with the rest of the members: until the ordinary Court expresses its opinion, the Committee will not take any steps or moves . This morning it will limit itself to taking note of the communication sent by Todde's lawyers, in which the presentation of the precautionary appeal was made official. The Committee, which has ninety days to report to the Council, will meet again perhaps as early as March 21.
Will the civil judge be able to grant a possible suspension only on the pecuniary sanction of 40 thousand euros or also on the request for forfeiture? Most jurists agree that the decision will concern both aspects. However, for some experts, the ordinary judge is competent to express an opinion only on the pecuniary sanction.
