The Electoral Guarantee Board at the Court of Appeal of Cagliari was divided on the request for the dismissal of President Alessandra Todde, which was sent to the Regional Council, and in the end a majority decision was reached: 4 to 3. This is what can be understood by reading the minutes of the Board, jealously kept under lock and key, and now leaked after the governor's decision to appeal to the Court both against the 40 thousand euro fine and against the declaration of dismissal.
In addition to the president Gemma Cucca, the body responsible for examining the candidates' financial statements also included the magistrates of the Court of Appeal Francesco Alterio and Dario De Luca, the judge of the Juvenile Court, Salomè Bene, the accountants Tullio Conti and Roberta Asuni, and the university professor Riccardo Fercia. The minutes show that the Board had to make various decisions "by majority" , with opposing positions among the various members.
But it was in the session in which it was decided to sanction the governor with the order-application for forfeiture sent to the Regional Council (but also to the Prosecutor's Office to evaluate any criminal aspects) that it was understood how the positions within the College were very distant. At the final decision, the score was three to three, then the president of the Court of Appeal, Gemma Cucca, expressed herself in favor of the sanctions.
