Todde case: a way out is emerging, Elections council perhaps incompetent to decide

The majority is growing in optimism about the case of the dismissal of the President of the Region Alessandra Todde. Speaking about the possibility of a dissolution of the Regional Council, the leader of the Democratic Party Roberto Deriu explained that «in theory all the possibilities exist, in practice we are confident that the legislature will continue» .
For days the majority has been engaged in studying the case, in close contact with a pool of Sardinian legal consultants and not only. A way out is emerging, because the Council Elections Committee could declare itself not competent to deal with the dismissal of the president, who is a regional councilor by right, not elected like the other members of the Sardinian parliament . Instead, she was elected president of the Region.
As provided for in the injunction order of the electoral guarantee college, the adoption of the measure to remove Alessandra Todde from the office of President of the Region requires the intervention of the Regional Council for its own competence. For its competence, the Sardinian Assembly acts through the activity of the Elections Committee that will be convened this week but that is already informally talking with the President of the Council Piero Comandini. Among other things, the Elections Committee verifies the admission qualifications of the councilors and examines the causes of ineligibility and incompatibility, including those that have arisen. Like the one concerning the governor. And it reports to the Council within ninety days from the moment it becomes aware of it, formulating the relative proposals for validation, cancellation or removal. Instead, a proposal for a resolution on the incompetence of the Committee to decide could arrive in the Chamber .
The problem, in fact, is that Alessandra Todde is not an elected councilor . According to the electoral law, she is the elected president of the Region and “only” a regional councilor by right . This is why, probably, the Election Committee will declare itself incompetent to examine the case. A judge could decide, but only if Todde makes the announced appeal. And, apparently, no appeal will be filed today or in the coming days .
