The judge acquits Blanco for the roses destroyed in Sanremo: «He was tense about the race». But he was just a guest

As requested by the Prosecutor's Office, the Imperia investigating judge acquitted Blanco, who was investigated for damage in the case of the stage destroyed while he was singing at the Ariston in Sanremo 2023 , thus rejecting the opposition presented by Codacons. But he does it for the wrong reasons, i.e. recognizing that the 21-year-old from Brescia had acted due to the pressure of the singing competition. Although Blanco, who won Sanremo 2022 with Mahmood, the following year only participated as a guest.
«In motivating its decision, however, the Court of Imperia commits a "gaffe" - Codacons announces contesting the sentence - attributing the artist's behavior to the tension due to the singing competition in which the artist participated... it is a pity however that in 2023 Blanco participated in the Festival only as a guest, to present his new song." In the provision, cited by Codacons, by investigating judge Massimiliano Botti we read: «In the case in question, it appears that the anger of Fabbriconi (the singer's name) was triggered by a malfunction of the audio system which, clearly, risked compromising its performance; in a context of strong tension such as that of the Sanremo singing performance, a harbinger of decisive outcomes for the career of each singer involved, the suspect's anger at an inconvenience that could compromise his chances of victory appears, if not justifiable, at least understandable ». «But Blanco - underlines Codacons - had no chance of winning, not taking part in any competition and being present at the Sanremo Festival exclusively as a guest! ».
«A circumstance which, on the contrary – according to the consumers' association – aggravates his behaviour, which is completely unjustified and highly uneducational, considering the high following of very young people boasted by the artist. Not only. For the investigating judge, the fact that the Municipality of Sanremo did not take legal action against the artist reduces the case of the destruction of the Ariston scenography, and makes it impossible to continue the investigation. In fact, judge Botti writes: "It is underlined that the Mayor of Sanremo, despite having made statements to the mass media in which he alludes to damage to the image of the city he represents (i.e. damage objectively greater than that caused to the floral arrangements considered in and of themselves), does not appear to have taken any initiative in the civil or criminal field against the suspect, appearing to attribute much less importance to Fabbriconi's conduct than that declared in the wake of the media outcry".
Codacons will now present a request to the President of the Court and to the Supreme Court, asking for the provision to be re-examined.
