The Constitutional Court rejected the Government's appeal against regional law 9 of 2023, the so-called Connected to Financial Maneuver, which contained some rules on the reorganization of the provinces.

The senior magistrates accepted all the objections of inadmissibility raised by the regional attorney's office in the appeal to the council of ministers.

We are therefore moving forward on the basis of the six Provinces plus two metropolitan cities: in fact, the exceptions raised by the Government's lawyers regarding constitutional legitimacy were of no avail.

According to the judges, those rules do not substantially modify the structure of the intermediate bodies, neither in number nor in their functioning, because it would not be the legislative power of the Region - we essentially read in the sentence -, but they limit themselves to specifying some marginal and detailed elements of the transitional phase and for this reason a referendum would not be necessary.

The saved rules are used to implement and define the transition to the scheme of six provinces plus two metropolitan cities, approved with law 7 of 2021 desired by the former centre-right majority, whose path, however, had been blocked by an initial ruling of the Constitutional Court, at the request of the Draghi government, and suspended after new opposition, this time from the Meloni government.

«It is yet another proof that finally the negative wave against the provinces, which comes from centralist environments of the various governments beyond political color - comments the group leader of the Democratic Party in the Regional Council Roberto Deriu -, has been pushed back by the Court, faithful to the values of the Charter. Now the citizens of urban, coastal, mountain and rural centres, the people, must recover their level of autonomous government which is precisely the Province. The next stage is the direct election of the bodies, all the group leaders - concludes Deriu - have signed the national law proposal and we will send it to Parliament".
