The Constitutional Court rejects the Sardinian law on cannabis

The law, approved in April 2022 and born from a bipartisan Psd'az-M5s proposal, had been challenged by the Draghi government. It concerns the cultivation of cannabis with a THC content within the limits established by European and Italian legislation and refers to the cultivation and transformation with subsequent marketing in the regional territory.
The Constitutional Court has deemed illegitimate the point in which whole plants, parts of plants and fresh or dried branches and derivative powders obtained from grinding, screening or sieving are included among the products obtainable and marketable from the cultivation of hemp. In essence, the marketing of inflorescences and derivatives .
The inclusion of inflorescences for the Court goes beyond the perimeter of regional competence in the field of agriculture and contrasts with the state regulations on the cultivation of cannabis «which the constant jurisprudence of this Court considers to be an expression of fundamental principles for the protection of public health » .
