The guarantee of the vote of the parliamentarians does not depend on the decree on the super green pass.

This was established by the Constitutional Court, which today examined in the council chamber the appeal for conflict of attributions between powers against the Government, raised by five parliamentarians residing in Sardinia and Sicily, judging it "inadmissible".

The disputed provision (concerning article 1, second paragraph, of law decree no.229 of 2021) requires that, starting from January 10, access to public transport is subject to possession of the so-called super green pass, and therefore on the condition of having completed the vaccination cycle or being completely cured of Covid.

The applicants, without the super green pass, argue that this provision prevents them from participating in parliamentary work, in particular (but not exclusively) in the election of the President of the Republic, scheduled for January 24: residents of the islands, in fact, could not reach the Parliament building by public airplanes or ferries without green certification. Therefore, given the urgency, they also ask for the precautionary suspension of the provision that provides for this obligation.

Pending the filing of the order, the Communications and Press Office of the Constitutional Court makes it known that the conflict has been declared inadmissible.
