The Council of State overturned the decision of the Administrative Court which had condemned the Municipality of Sassari to pay the Immobiliare San Giacomo a maxi compensation of 42 million euros which could also have caused the bankruptcy of the institution.

After the sentence of the Tar (in December 2020), the Administration of Nanni Campus had filed an articulated appeal: in 43 pages it dismantled what was declared by Immobiliare San Giacomo and presented all the points for which the sentence should be "fully reformed" . On 22 October the Council of State substantially accepted the motivations of the City lawyers.

“We are certainly satisfied with this result, which in reality we have always believed - commented Mayor Campus -. We are finally closing a story that has gone on for too long and has caused serious concern, even among the staff of the Municipality who have always carried out their work with attention and dedication, following the rules and applying them correctly ”.

Following the sentence of the TAR, a note from the Municipality of Sassari reads, "the company has in fact presented a request for access to the documents to identify the names of all those who, for various reasons, had been involved in the affair, who according to the San Giacomo they would have caused the huge damage complained of. This is because the company also intended to evaluate the opportunity to apply to the Court and the Court of Auditors to ascertain any further responsibilities related to the serious economic damage it believed it had suffered ".

“Three pages in which the company asked for 'full particulars' of public employees who have done nothing but do their job. And if on the one hand we have immediately protected these people from any possible 'psychological violence' to which they might have felt subjected, on the other we have moved with even more diligence in starting the appeal, sure of having the right on our side. And the facts proved us right ”, concluded the Mayor Campus.

THE EVENT - In 1993, the municipality rebuilt, the administration “approved a development plan for an area in via Budapest, with two companies involved. Of the two, one asked to enter into the agreement, but subsequently failed. The San Giacomo srl, which took over after the bankruptcy, ten years later the agreement was denied because - according to the municipal offices - after 10 years the plan was no longer valid. The real estate company had appealed, winning it. With this now definitive sentence because the Municipality decided not to appeal, Immobiliare San Giacomo asked the TAR to calculate the compensation: 42 million euros. The decision of the Administrative Court approved the company and asked the Municipality to "present a concrete proposal for compensation '". The Municipality had therefore chosen the path of appeal, won.
